SEPARATION MEDIATION

People sometimes consider separating for a period before officially terminating a relationship.  Mediation can help couples to discuss the pros and cons of separating versus staying together or divorcing.  Mediators can help couples to evaluate their situation so they can determine which path is most desirable.  Mediators usually have extended referral lists including marriage counselors, individual counselors, spiritual advisors, support groups should the couple desire information of that sort.  Mediators are trained in communication enhancement and conflict resolution.  The Mediation experience provides the couple with ample resources enabling them to feel better equipped to make determinations about their future.

Using the mediation process, couples can are able to establish amicable boundaries for the separation and formalize them in writing.  The Separation Agreement covers such topics as spousal support, property distribution, asset division, personal responsibility.  If there are children involved, the parties can devise a format for meeting their needs both financially (child support) and emotionally throughout the process as well.  Legal Separation is uncommon in Illinois as it can be as costly as divorce, however, Separation Agreements can be legally binding contracts.  You can contact your attorney to learn more.  If you do not have an attorney, your Mediator can refer you to a Mediation-Friendly attorney in your area.
